Research Abstract |
Our research during the fiscal years of 1992 and 1993 were conducted in such forms as : the project members' personally conducted research activities, meetings for discussion based on the member's presentations, and other forms including inspection and hearing of related matters. Our report was being prepared during the second half of the 1993 fiscal year with the following contents : The first part is analyzing current Japanese domestic laws concerning natural environment protection. Such laws include Natural Environment Preservation Act and Natural Park Act, forest laws, Wildlife Protection Act and Game and Hunting Act, Cultural Properties Protection Act, and Endangered Species Preservation Act. Secondly, current international legal schemes are studied. After making a survey of treaties for natural environment protection, specific attention is paid to the internationally designated area system, area designation proceedings for natural environment protection, schemes for efficient enforcement of treaties, and international assistance systems. Thirdly the status quo of regulatory and supervisory methods is analyzed. The methods include land use regulation and controlling with the aid of "money", such as compensation, agreement, or fund. Our proposals for improvement follow this analysis. Finally, current legal schemes and methods in other countries being used for natural environmet protection are studied. Such countries include U.S.A., Sweden, France and Germany. For the fiscal years of 1994/1995, based on the above research, the same members are willing to engage in an international academic activities, which would pursue the same topic. The members would visit various countries with the purpose of making further detailed researches on foreign laws, which could make possible our rethinking of Japanese law system.
