| Research Abstract |
The aim of our project, which has been conducted from 1993 to 1995, is to examine positively the process of de-socialization and reform of legal systems in Russia after the collapse of the Soviet Union.
To accomplish the aim, as a beginning, we analyzed the substances of revisions of the Constitution of the USSR and that of Russia enacted under the Perestroika starting from 1985 or 1986, revisions of various laws in different fields and newly enacted laws. The result of the analysis makes clear the historical characteristics of the "Soviet Law" in this stage. Next, confining the object of research especially to Russia, we analyzed the reform of legal systems under the Post-Perestroika which has proceeded a full-scale policy of de-socialization, namely "re-capitalization followed by the collapse of the Communist Party and the breakup of the Soviet Union after the coup d'etat in 1991, so that we try to make clear the characteristics in transformation of legal systems accompanied with de-socialization and its consequence.
In spite of the enactment of a new Constitution in December 1993 in Russia, however, economic crisis and political instability has been continuing, so that the transformation to the new legal system, which must be a legal consequence of de-socialization, namely "recapitalization", has not been completed yet. In this sense, we can say that the present study is not covering all fields of our legal concern. We, therefore, place this report as an interium of our further research.
In near future, this report will be publicized as a final report with certain fields left out of the present research.
