Research Abstract |
(1) The primary system of suit for money of Sendai-clan was made in the end of 17th century under the influence of law of Bakufu, especially aitai-sumashi-rei (the law of rejection to accept the suit for money). (2) The establishment of the system was made among 1720-1740. The model of it was the law of Bakufu. But the contents of it didn't agree with the law of Bakufu. It brought more profits to the obligors than the law of Bakufu. Because Sendai-clan wanted to save the obligors, especially samurai. (3) In 1750's Sendai-clan changed the system of suit for money to bring more profits to the obligors. (4) From 1760's to 1860's Sendai-clan often promulgated moratoriums for relief of samurai. So samurai didn't need to pay money to the obligee. Thus the system of suit for money of Sendai-clan was broken down.
