Research Abstract |
This project aims at researching of international trend concerning copyright problem with rapid development of information society. In 1997-98, we reseached legal conditions of United States and EU contries following the last fiscal year, and Asian countries and Australia additionaly. 1.Head investigator Yoshida took an opportunity to partipate in WIPO/JAPAN COPYRIGHT AND NEIGHBORING RIGHTS TARAING PROGRAM held in Tokyo, November 1997, sponsored by WIPO (World Intellectual Property Organization) and Japanese Government. Many experts from Asian countries (Bhutan, Nepal, Laos, China, Korea, Mongolia, Indonesia and Philippines) participated this program. Through question and answer, exchange of views, Yoshida could grasp the conditions of those countries in spite of visiting those countries. 2.Co-investigator Suami researched the trend of EU countries following the last year. Recently, EC has enacted many 'Council Directive' on copyright problems to harmonize legal systems of Member States. Suami investigated the situation of consideration for new Directives at the EC headquarter and European Court of Justice, and the condition of United Kingdom that responds actively to copyright problem in digital age. 3.Co-investigator Murakami took part in this project last year from the viewpoint of the antitrust laws (a relation of intellectual property law and antitrust law is remarkable, as the exercise of intellectual property right has a close connection with monopoly of information). Murakami investigated the condition of Australia this year. 4.Co-investigator Inoue researched the condition of United States, particularly technological development and market trend of information industries in United States. Additionally, Inoue investigated cooperative studies by industries and universities concerning the protection of copyright, and the circumstance for a new copyright legislation.
