Research Abstract |
In this study, each investigator has examined the following issues by comparing with German Law and American Law : the social security system overall including the public pension system, the legal procedure in case of bankruptcy of public or private pension system, what the supervision system related to a variety of private insurance should be, and what the investment type funds for the public pension system should be. Concretely, the head researcher MOTOZAWA Miyoko has analyzed the central issues of the reform of the Public Pension System in H.16 fiscal year (nendo) and examined the matters lasted hereafter. Researcher DEGUCHI Masayoshi has published his research, referred to German Supervision System relating to private insurance, of insurance companies' continuous solvency. rcher MURAKAMI Masako has scrutinized, referred to German Law and American Law, the measures under the Proceeding Law in the event of bankruptcy of public or private pension system. Though this series of research, under the situation that the social security system has been individualized, for adjusting a gap of pension rights between husband and wife and a gap between the insured who bear the family responsibilities and who does not bear it, we came to the following conclusions : it is necessary to value the family responsibilities properly and socially, and we should pay attention to the relations with other systems while considering of countermeasures ; regarding to the private insurance which supplies the public pension system, it is essential to define supervision liabilities in order to make rational and proper government ; and undoubtedly, it is indispensable to deal with measures under the proceeding law in case of bankruptcy of public or private pension system. Finally, we agree that we should develop those researches hereafter, and continue to examine the remained issues for building a Lifetime Style Incoming Security System. Less
