Research Abstract

「法体験」が「法知識」よりも「法関心」を高め、さらに法イメージにも影響を及ぼす傾向にあること、「法知識」はネガティヴな「裁判イメージ」を強め、「契約に対する否定的イメージ」を弱める傾向にあること、「法体験」がある者は「法知識」に基づいた法イメージを有する傾向があることなどを明らかにした。経験や知識は必ずしも直接は法律家の「漠然とした」信頼感には影響していない。裁判官や弁護士の有する「権威性」(職業上の専門性や社会的地位に由来する)ゆえに、「お上意識」の強い人は法律家を信頼する傾向が弱いながらも観察された。法意識の構造については、70年代日本文化会議との比較を、カテゴリカル主成分分析を用いて行った。そこでは、第1成分「無関心」と第2成分「寛容〜厳格」という70年代と同じ構造が発見された。しかし、第3 成分では「法への反抗的態度」、第4成分では「人権重視」が見いだされ、70年代日本文化会議の知見とは異なっている。基本的な構造を維持しつつも、日本人の法意識は変化しつつあることがみてとれる。
