Research Abstract |
In this research, a lot of files (fascicoli) of criminal cases of Naples from 1890's to 1920's are analyzed and contextualized in the pluralistic structure of Italian legal culture, being focused to so-called "causa di onore (causa lionoris)" articles of Italian Criminal Code (1889). In July and August 2004,and in march 2005,many case-files of this kind were searched for and transcripted at the Archivio di Stato di Napoli, in contact with the italian historians of law for the discussion, especially Domenico Rizzo, whose suggetions on gender studies were illuminating so much. Consequently, two case-studies on infanticide (Tribunale penale di Napoli, fascio 7-fascicolo 99,1904;fascio 16-fascicolo 724,1901) are published as a tentative micro-analysis of the interactional process between legal system and legal subject. In addition, a comparative history on "causa di onore" in the criminal codes of four countries (Italy, France, Germany, and Spain) will be published on the forthcoming book (ed.by M.Tanaka).
