Outline of Final Research Achievements

Japanese Supreme Court once decided that the principle of ownership in the modern era was the single ownership. I argued that this theorem is not self-evident by referring to the past legal system and common practices of Japanese ownership regarding forests.

Academic Significance and Societal Importance of the Research Achievements

最高裁判所の判断を前提とする限り、共有は単独所有に復帰する分割請求権を保障しない限り、憲法29条の財産権保障に反することになるが、それにより共有は不安定な権利となりかねない。しかし、有限の地球資源を持続可能なものにするためには、共有型経済こそが今後のあるべき姿と考えるべきであり、本研究は法的観点からそれを基礎づけるものである。
