Outline of Final Research Achievements |
This research aims to build theory to consider family-member-obligations at estate division. Whereas in Japan funeral expenses could be imposed on decedent’s family, in French law traditional concept “charges de la succession” contains theory to make an estate division after funeral expenses. And this research aims to examine system to protect surviving spouse’s habitat. French law has a variety of solutions : Marital property arrangements, special donation, life right of residence, preferential settlement, and so on. It permits surviving spouse to choice optimum way, and at the same time, protects his/her habitat under any circumstances.
