Outline of Final Research Achievements	Because Japanese Civil Code doesn't have any text of the trust principle, this study justified the rule of the trust principle and analyzed which rules should be legislated in our civil code.So,we can aim to protect some creditors by giving more effective remedies of priority and to deter some potential debtors from doing illegal conduct.Our existing code including conventional ideas should be changed or be altered.
Academic Significance and Societal Importance of the Research Achievements	学術的意義としては、先行する関連議論を踏まえた総括であること、執行による実現までをふまえた考察であること、抽象的理論や批判に止まらず社会的制度への具体化としての意義がある。また、社会的意義としては、民事法による救済をより実効性のあるルールとすること、法を知る者が救済されない者のいることを知りつつ侵害行為や隠匿行為を敢えて行うモラルハザードの抑制を実際的に進めうる制度の1つとなる意義を有する。
