Outline of Final Research Achievements |
I examined insurance contracts from a viewpoint of sanctions and deterrent effects. Sanctions against the policyholder side: in the current Japanese insurance law, the exemption by serious grounds has been introduced. This shows the characteristic from sanctions against policyholder side. Sanctions against the insurance companies: for example, if policyholders expect something other than intent of contracts and the insurance company easily could understand that, recovery of damages for mental suffering can be accepted for the reason of deterrent effects.
