Outline of Final Research Achievements

This research is a study of governmental interpretations of the constitution and the function of the legislature to control these interpretations.
I explain or consider that the role of the legislature in parliamentary cabinet system is mainly let the government make clear their interpretation and ask the consistency of it, and legislature also make their own interpretations of the constitution when they enacted laws.

Academic Significance and Societal Importance of the Research Achievements

日本において、集団的自衛権の行使の一部容認など、政府の憲法解釈が大きな注目を集めた。この政府の憲法解釈の問題を考えるにあたっては、なぜ政府が憲法解釈をすることができるのか、それにはどのような制約があるのか、制約を加える主体は誰なのか、とりわけ議会はどのような役割を担うことができるのかを問う必要がある。さらには、このような憲法解釈に関する問題は、憲法のデザインする統治構造によって表面化の仕方などが変わって来るのかといった点も明らかにしなければならない。本研究は、従来不十分であったこれらの検討を行うものであり、学術的意義と社会的意義が認められる。
