| Outline of Final Research Achievements |
Having studied constitutional theories in the United States and current circumstances surrounding human rights, this research showed that to construct deliberative democracy in modern society, it is not enough only to protect human rights essential to deliberate, such as freedom of speech or equality among citizens. We need also some regulations on human rights to construct deliberations among free and equal citizens, such as regulations on defamations on the Internet.
In addition, this research considered theoretical relationship between populism and deliberative democracy, and got some clues to construct deliberative democracy in populism age.

| Academic Significance and Societal Importance of the Research Achievements |
民主政治を、単純な多数決ではなく市民相互の討議と熟慮に基づく熟議民主政であるべきとするならば、表現の自由や市民間の基本的な平等など、熟議の前提である憲法上の権利保障のあり方も再考する必要がある。たとえば、表現の自由といえども、各人が好むように表現活動を行う自由であることを意味するのは当然であるが、その行き過ぎによって討議の前提が大きく阻害されるような場合には、何らかの規制の可能性を認めるべきである。これまで、精神的自由は国家の制約を排除する自由として理解されてきたが、熟議民主政の下では、討議のために一定の規制を許容する自由としても理解されるものとなりうる。
