Outline of Final Research Achievements |
The dismissed resort to law even at the great expense of himself and the family, trying to bring about novelty to the domain of labor trial in the field of labor movements, because they believe their value and norm will be shared by society and they are actually supported by society. Accordingly, we may conclude that the dismissed employees with whom I had come into contact had the ultimate objective of leaving in visible forms to posterity their value and norm sharable by society. Therefore, we need to design how to attain such ultimate objectives for dispute resolution and prevention.

雇用調整の一環として行われる整理解雇は経営の意思決定で行われるが、整理解雇の実施や整理解雇をめぐる労使紛争の管理について経営学が正面から深く考察することはこれまでほとんどなかった。 本研究は整理解雇をめぐる裁判経験事例の研究を通して、紛争当事者が裁判、さらには上告という紛争の長期化・大規模化に至る要因を明らかにするとともに、紛争の長期化・大規模化に至る紛争当事者の規範や内面の解明に取り組んだ研究である。
