Outline of Annual Research Achievements

グローバル金融危機は、民間企業の経営破綻のみならず主権国家の対外債務（ソブリン債務）の不履行をも誘発し、金融市場を大きく混乱させる。そこで、事後処理方法である「ソブリン債務再編」のメカニズムを構築することが急務であるものの、これまでの議論の方向性は、「国際破産裁判所」といった強力な国際制度の成立を目指す野心的なアプローチと、公債契約の文言の微調整にとどまる抑制的なアプローチとに二極化する傾向があり、議論状況は今なお混沌としている。そこで本研究では、ソブリン債務再編の国際法秩序構想に関する第3の理論的な方向性を提示し、その現実適合性を実証することを通じて事態の打開を試みた。具体的には、次の2点に関する理論構築・実証分析を課題とする。(a)国際公序概念に基づく債権者の行動の規律：国際私法上の公序概念は自由な渉外的取極めに内国法上の価値に基づく制約を課する。そこで、そうした公序を根拠として、国家による債務再編を阻害する「抜け駆け訴訟」を却下あるいは中止すべきとの議論が成り立つかを明らかにする。(b)グローバル行政法論に基づく債務国の行動の規律：(a)の論証により、訴訟や仲裁を通じた債権者の救済の契機が一部閉ざされてしまう。したがって、国家による債務再編を国際法の規律の及ばない留保領域ではなく、いわばグローバル・ガバナンスの一形態として把握し、説明責任や透明性といった手続的規律を通じて、マクロ経済政策の必要性と債権者の利益への配慮との適正な調整を債務国に求められるかを明らかにする。

本研究課題は事業者の異動に伴い廃止することとなったため、当初の研究課題に対する回答を得るには至らなかった。他方、「研究発表」の項に記載した断片的な成果をいくつか公刊することができた。その統合的な把握の試みは、次の研究課題として再設定する予定である。
