Outline of Final Research Achievements

This research project focuses on strategic behaviors of the Supreme Court of the United States in constitutional cases related to abortion regulations. In particular, this study investigates political and social contexts which influenced the judicial decisions on the abortion cases.

本研究の成果の学術的意義や社会的意義として、次の各点を挙げることができる。第1に、本研究は、アメリカにおける中絶に関する法と政治の歴史について、法学のみならず、政治学などの隣接分野の研究動向を参照しながら調査を進めた。第2に、本研究は、アメリカにおける中絶規制に関する憲法訴訟の最新の動向について調査を行った。第3に、本研究は、現代アメリカ政治の特徴であるイデオロギー的分極化を前提とした司法審査理論について、調査と考察を進めた。
