Outline of Final Research Achievements |
This study clarified the legal and institutional requirements for guaranteeing employment support for persons with developmental disabilities "right to the opportunity to gain a living by work" (Article 27 of the Convention on the Rights of Persons with Disabilities), using German and U.S. law as a comparison. First, supported employment with continuity should be positioned in employment support legislation to provide qualitative guarantees, second, individualized support such as job coaches should be guaranteed as part of reasonable accommodation, and third, an income guarantee system should be established that is systematically consistent with employment support legislation.

Academic Significance and Societal Importance of the Research Achievements |
就労支援と所得保障は、必ずしも発達障害者の特性に配慮した給付とはなっていないのが現状であるが、職場での個別的支援の保障、障害者作業所の位置づけの明確化、賃金の補助と職場での支援を組み合わせた給付などにより、発達障害者にも就労支援を保障することができ、経済的自立の可能性が高まる。 本研究から得られた示唆は、日本において、今後の障害者の雇用保障施策の方向性の検討や政策立案の参考になると考えられる。
