Outline of Final Research Achievements |
In the French theory of the transformation of collective property collateral, subrogation has gradually been used to explain the continuance of the security effect. Subrogation is not considered as a fiction but the representation of intention of the parties. Through the analysis of Japanese practice survey, edict and Supreme Court cases, the abolition of the forclosure which would protect pledger was not accepted easily and this is because the redemption enables the pledger to continue cultivation.

フランスにおいて物上代位論の根拠づけが擬制から当事者の意思へと変容してきたこと、しかもそれが集合物の構成要素について論じられた点を明らかにすることを通じ、流動型担保の説明概念としての分析論と集合物論とを統合する可能性が見いだされる。 また、流質禁止の緩和はフランスにも見られるところであるが、手続費用の節減という観点ばかりでなく受戻可能性を残しておくことで、担保権を実行しつつも設定者の事業を継続させる道を見出しうる点で、社会的意義を有する。
