Outline of Final Research Achievements |
By supporting the position of truth theory by the philosopher David Wiggins, I tried to show in my research that the issue of truth is a major factor in legal judgement of objectivity and validity. By meeting Wiggins himself, I was able to show that there are actually practical examples of his theory of truth in the realm of Anglo-American law. Additionally I tried to elucidate Wiggins' position on truth theory and apply it in Anglo-American and Japanese law. The results will be compiled as a monograph.

Academic Significance and Societal Importance of the Research Achievements |
従来の法学において支配的な考えは、法的判断や価値判断には真理を問えず、その帰結から法的判断の客観性一般は否定され 、法的判断の妥当性は真理や客観性の問題とは別の要素から引き出されることが多かった。しかしながら、この研究では改めて真理概念に注目することで、法的判断の問題に新たなアプローチを示す意義を持つ。またこうした議論は非常に理論的かつ抽象的なものに陥りやすいが、この研究では英米法や日本法の文脈に適用することで、実践的な問題にも接続することを試みた。
