Outline of Final Research Achievements

As an exploratory research in the field of private international law, this research made an attempt for developing a mathematical model for depicting the function of choice-of-law rules. With the tentative mathematical model, this research especially worked on analyzing the legal theory of qualification in private international law.

本研究の成果は、国際私法分野において数学的概念を用いる新しい分析手法を導入するものであり、学術的意義があるものと考える。法学において本研究のように数理モデルを活用する先行研究は未だ限定的であることを考慮すると、その意義は国際私法分野にとどまらない。また、本研究の成果は、国際的民商事紛争を解決するための法分野において、実務上も極めて重要な法性決定の問題を検討対象としていることから、社会的意義も有する。
