Outline of Final Research Achievements |
In this project, We dealt with the new residential area relocation project (as managed retreat) that was carried out in the Aonae district of Okushiri Island, which was damaged by the earthquake and tsunami. We examined legal issues at each stage of planning, consensus building between administration and residents, and project execution. We confirmed that, in areas facing depopulation and aging, it is essential to develop town areas that would enable early securing of housing, and to improve the environment for securing livelihoods. And also that it is important to improve the registration system (which is being revised recently) and to handle usufructuary rights in order to smoothly secure sites. Maintain and improve the practical ability of local government officials who are in charge of the administrative processing of site acquisition, and support from other local government officials who have knowledge, skills, and experience is critically important.

Academic Significance and Societal Importance of the Research Achievements |
災害復興では、必要以上の市街地整備、人口縮減・高齢化と市街地整備とのミスマッチ、用地処理の困難による復興の長期化が指摘される。過去の記録と分析が、将来の災害復興を少しでも改善できるかもしれない。本研究の社会的意義はそこにあろう。また、社会の実態をより踏まえた方法論による法律学の必要が言われる。本研究も、実務の一次資料を踏まえて考察してきた。裁判例の羈絆から解放された法律学の可能性の追究が本研究の学術的意義であった。 もっとも、達成できたかどうかは心許なく、さらに精進を、と考えている。
