Research Abstract

I performed research trip in 2007 to Argentina and Uruguay.
The unconstitutionality judgment on impunity laws of Argentina Supreme Court reflected development of the international humanitarian laws and memory politics in Argentine about military regime. Many NGO s have struggled against Two Devil Theory, which insist both guerillas and military have responsibility for coup d' etat and violations of human rights by military. CELS took an important and active role in the struggle of court to carry off that sentence.
I also analyzed the influence of that historical judgment of Argentina Supreme Court on Uruguay. Many Uruguayans disappeared in Argentina by security forces of Argentine and Uruguay. That sentence would authorize and accelerate requirements of extradition of suspects in human right violation. President Basquez decided to bring some ex-military persons to trial, who were suspected some famous cases of violation of human rights that have been objected of Uruguayan impunity law. And he also decided to hold a ceremony to interpret "national reconciliation". That ceremony, named "The Day of Never Again" (el Dia de Nunca Mas) took place on June 20, a birthday of Artigas, who was a national hero of Uruguay. One of the SERPAJ-Uruguay member to whom I interviewed criticized that ceremony because that based on Two Devils Theory. She also analyzed the sentence of Argentina Supreme Court would have positive influence on the movement to collect signatures for annul of impunity law in Uruguay, which began in this September after 2 years preparation. (Fortunately I attended that promotion rally at last day of my field work). I predict the problem of the historic memory and prosecution of criminals of crime against humanity would be key issues in Uruguay in future.
