Research Abstract

カントの「批判的方法」を基に「平和のうちに生存する権利」(日本国憲法前文)の「形而上学的」解明をおこない、次の結論に至った。
(1)「21世紀の権利」といわれる「平和的生存権」の形而上学的根拠は「自由」にあること、(2) この「自由」はその権利主体である「人格」「人格性」において「人格的自律」として確認されること、したがって、(3)「汝、平和を欲すれば、平和に備え、平和的生存権を培え」(『法律時報』1996年68巻9号61頁参照)。
という憲法学からの提言は最終的に「人格教育」(「教育基本法」第1条)の問題に帰着すること。
