Research Abstract

簡易裁判所での司法書士による代理権行使の件数は近年、増加しているが、その多くは金融機関からの金銭消費貸借の債務者側に関するものが占めており、そのなかでも過払い利息返還請求に関するものが多い。これは比較的定型的な要素が強く、かつ件数としても大量に存在することが大きい。その一方で、もめ事を抱えた市民が、最初に誰に相談するかは、その後、祖その問題がどのように処理(終結)されるかに大きな影響を及ぼしているにも関わらず、司法書士に認められた代理権行使は、簡易裁判所におけるその他の領域では、活発ではない。それは、司法書士の側に、訴訟代理をすることへの意欲が必ずしも高くなく、司法書士利用が問題を抱えたときの利用に偏っていることもその一員である。
