Research Abstract

1940年代初頭の刑事・治安法制の再編について、1941年刑法改正を中心に検討した。同法に新設された「安寧秩序ニ対スル罪」は、1940年4月に発表された改正刑法仮案中の同名の章より選択されたものである。同章の形成過程の詳細を明らかにし、刑法改正事業において見られた、治安法的な条文を規定する志向について明らかにした。また、同法には、同時期に制定された新治安維持法・国防保安法に含まれない罪を規定することにより、両者と既存の治安諸法を補完する役割が期待されていたことを指摘した。
