Research Abstract

外国国家機関が既に存在する私人の法的地位に何らかの影響を与える形で関与しているのであれば、その関与の積極性に拘らず、外国国家行為承認制度により当該国で与えられている効果を我が国でも認めるべきである(但し、それ以上の効果を付与する必要はない)。その際の要件としては、対象となる外国国家行為の機能毎に区別する必要はなく、外国判決の承認に関する民事訴訟法118条が要求するのと同様の要件を一律に課すべきである。
