Research Abstract

本研究の第一の目標は、全国的な裁判記録の閲覧を通じた解雇事件に関する全国的なデータベースの作成である。ここで採取されたデータおよび判例集から収集したケース・スタディ、さらに最高裁による事件票の特別集計を用いた実証的分析をすすめた結果、解雇を巡る個別紛争を解決するための社会規範を、従来の解雇権濫用法理が提示できるかは不確かで、さらなる研究の余地があることがわかった。
