| Outline of Final Research Achievements |
The family law theory of Shigeto Hozumi, one of the proponents of sociological jurisprudence that appeared in the Taisho era, was analyzed in line with his personal and social history research, so that the ways in which he approached foreign law were clarified. Hozumi did not deny or modify the laws received from foreign countries up front, but instead established a process for skillfully incorporating Japanese values in the field of dispute settlement depending on Jori or using mediation by law in coexistence with the foreign law. As a result, this made it possible to realize practical dispute settlement rooted in society during that era.

| Academic Significance and Societal Importance of the Research Achievements |
本研究を通して、現代における家族法学の方法論の原型を穂積重遠が築いたことが明らかになった。彼の学説の背景には、日本の伝統的価値観との調和を図らねばならないという要請が強かったという当時の時代状況があった。このような認識に立った上で、現代においても、彼に由来する方法論をそのまま適用できるのか、あるいはその方法論の限界性を認識して新たな方法論の模索に入るべきなのか、こうした点を実定法分野において今後考えるための一資料を提供できたと考えている。
