Outline of Final Research Achievements |
Regarding the insanity and the diminished responsibility stipulated in Article 39 of the Criminal Code, especially the latter, the following is clarified from criminal trial and treatments of mental illnesses in France. First, individual rights of the suspect / defendant are guaranteed by the provision of the diminished responsibility. The fact that it is not just a sentencing situation, but a binding legal cause for lightening, causes the court to carefully scrutinize the claim of diminished responsibility. Second, legal or judicial aids are required for suspects and defendants with mental illness to play an active role in criminal trials. For example, conduct a criminal psychiatric assessment, fully respect it, and actively recognize the involvement of specialists such as psychiatrists.

Academic Significance and Societal Importance of the Research Achievements |
本研究の最大の学術的意義は、責任主義が、その本質において、刑事訴訟手続と不可分に関連している可能性を明らかにしたことにある。つまり、刑事裁判において被告人の主体的地位を保障するために、一方で、刑法には、強い法的拘束力が認められるかたちで、責任能力に関する規定が置かれる必要がある。他方で、刑事訴訟法には、精神鑑定の実施や精神科医等の専門家の関与を促す規定が置かれ、実務上もそれを尊重することが望まれる。このように、責任主義について、実体法と手続法を貫く視覚は、従来の先行研究ではあまり意識されてこなかったものである。
