| Outline of Final Research Achievements |
In the wake of traffic driving fatal accidents caused by epileptic seizures, the Act on Punishment of Acts Inflicting Death or Injury on Others by Driving a Motor Vehicle was enacted, and the Road Traffic Law was revised. Legislators believe that stricter penalties for illness and voluntary return of driver's licenses are effective in preventing traffic driving fatal and injury accidents. The results of this research are as follows.
First, stricter penalties for motor vehicle driving deaths and injuries caused by certain illnesses are problematic under the Convention on the Rights of Persons with Disabilities.
Second, to promote the voluntary return of driver's licenses, it is important to provide mobility support to vulnerable people in traffic.

| Academic Significance and Societal Importance of the Research Achievements |
交通犯罪対策として、てんかん発作など一定の病気に起因する自動車運転死傷事故を防止する目的で法整備がなされた。他方で、道路交通法の改正が重ねられて運転免許証の自主返納が推進されている。本研究の学術的意義は、一定の病気を理由とする自動車運転死傷事故に対する厳罰化について、てんかん発作に起因する自動車運転死傷事故の裁判例を取り上げて障害者の権利に関する条約上の問題があること、道路交通法の改正など運転免許証の自主返納を促進する施策が進められているが、交通弱者の移動手段の確保という課題があることを明らかにしたところにある。
