Outline of Final Research Achievements |
From 1882 to 1908, there was a supplementary punishment of surveillance by the police for criminals. The documents of those days tell us that they were watched as well as ex-convicts, vagabonds and unemployed. Their mobility rights were limited, including freedom to travel. It was mandatory to carry passports for domestic traveling. The explanation of the system said it was for maintaining the order, but in the early discussion, they considered that the passports would enable to save officers trouble and secure the criminals.

Academic Significance and Societal Importance of the Research Achievements |
本研究により、明治期初期に形成された警察により、再犯防止のための監視の具体的な内容が明らかとなった。被監視人は、自由な転居や旅行が許されず、常に警察から許可を得る必要があった。旅行については、旅券の携帯が義務化された。なお、明治9年には、川路利良により国民一般の内国旅行における旅券携帯義務が構想されていたが、川路のいう治安維持や犯罪者探索の便宜とは別に、官吏の手間の短縮や被監視人の人身保護も考慮されていた。また、旧刑法附則はその編纂経緯が明らかではなかったものの、本研究により、少なくとも監視規則については初案との類似性が認められた。今後は初案との比較による分析視点が得られた。
