Research Abstract |
ドイツにおける閉店規制は、20世紀前半には小売業従業員の労働時間保護が目的であったが、第二次大戦後1956年に制定された閉店時間法の関連議論を追ってみると、従業員保護もさることながら、新たな論点として重視されたのが、競争中立性という観点であった。これは、小企業と大企業の平等な競争条件を作り上げるという秩序政策的な考えから出されたもので、市場が十全に機能するための秩序を作り上げるという戦後西ドイツ社会的市場経済の政策目標とも関連性を持つものであった。
