Research Abstract

一連の水俣病事件訴訟の検証を通じて明らかになったことは, 病像論に関する見解の相違が平行線をたどったまま今日まで未解決であることに明らかなとおり, 裁判による行政のチェック機能には制度的に限界があり,わが国の権力分立制においては, 裁判を通じた社会の公正な秩序を形成機能は, 一定程度実現可能であると同時に, 他方では大きな限界に直面している, ということである。
