| Research Abstract |
本研究の主たる対象は、国境を超える保険取引から生ずる利益の帰属をめぐる課税管轄権の問題である。対象とする保険取引は、保険会社の親子会社形態、本支店形態及び一般法人が国外に設立するキャプティブ形態によるものである。本研究は、国内法上の問題に留まらず、わが国が締結する租税条約上の問題にも関係し、国際保険取引に係る移転価格税制の問題を含めて比較法に基づく調査・分析を行った。
