Research Abstract	外国判決の背後にある請求権に対してわが国において執行債務者が異議を申立てたいと考えた場合に、執行債務者はどのような手段がとりうるのか、という問題について、わが国外国判決承認執行制度の母法といえるドイツにおける比較法的議論を検討の視座とし、この問題に含まれる理論上の問題点を比較法的に整理し、わが国における従来の議論と比較したうえで、この問題を考える上での今後の検討課題を明らかにした。
