Research Abstract |
本研究ではまず、カルタヘナ議定書の締結を1つの重要な契機として、国家の一方的な予防的行動を正当化するという予防原則の新たな意義が学説でも指摘されるようになっていることを示すとともに、同原則の法的性質や適用基準をめぐる論点や課題を整理した。そのうえで同議定書における予防原則の機能の実証を行い、同議定書に規定された「予防アプローチ」の意味を明らかにするとともに、予防的に輸入を制限する国家の権利の射程の検討を行った。
