| Research Abstract |
近代学派学説の中で、期待可能性という概念は責任論のみならず行為論とも関係づけられるという示唆を得るとともに、刑罰論において刑罰本質論と刑罰目的論という基軸に着目することが有益であることを見出し、「刑罰本質論上の応報刑論と組み合わされた刑罰目的論上の特別予防論」という理論的枠組みを提示した。
