Research Abstract

本研究の目的は、「正義へのアクセス」に関わる法律専門家の倫理と責任について、日米の比較検討を行うことである。研究実施計画に基づいて、平成19年度は米国、平成20年度は日本での現地調査を実施した。米国調査からは、単に弁護士の数を増加させても正義へのアクセスは必ずしも改善されず、弁護士個人の責任の自覚(ミクロレベルでの改革)および法サービス拡充のための制度的基盤(マクロレベルでの改革)の両方が必要であることを発見した。また、日本調査からは、日本司法支援センターのスタッフ弁護士が、これまでの日本の弁護士像とは異なる、新たな弁護士像を構築していることが発見された。
