Outline of Research at the Start

今日の法秩序は、各国の内部では完結せず、国と国の関係を前提とした国際法でも規律しきれるものではない。国境を超えた法の展開は、国家の立法・行政・司法を通じた法の定立・執行・裁判に加え、市民やNGOの社会活動、企業や市場のプレーヤーの経済活動の中でのインフォーマルな規範形成をふまえて初めて理解できる。本研究は、その規範形成のメカニズムを、移民・団体のガバナンス・憲法規範など具体的なテーマから検討する。

Outline of Annual Research Achievements

2019・2020年度に引き続き、2021年度も、国際的な法規範の形成・伝播・変容という大きな枠組みの中で、研究代表者と分担者でそれぞれの比較法と憲法の分野の特徴を生かしつつ、調査研究・成果発表の両面で協働してきた。
主な成果が、代表者と分担者が代表者と分担者が共同で企画したシンポジウム「同性婚訴訟――家族の多様化と世界的変化の中で」であり、日本の同性婚訴訟とアメリカ・台湾・ブラジルの展開との比較が実現した。分担者が編者となり代表者も一章執筆した『アメリカ憲法と民主政』も公刊された。
代表者は、信託の世界的伝播について海外で3件の報告、英文書籍への寄稿2件と充実した成果報告を実現し、2020年度以来の感染症対策に関する研究でも国際会議で報告する機会を得た。国内でも、公益団体とガバナンスについて日米比較を踏まえた論文を発表し、一定の手ごたえを感じている。
分担者も、同性婚訴訟に着目し、アメリカの判例を素材にしながら、アメリカでは判決自体がしばしば社会における評価対象となり、そのような磁場が存在しているからこそ、国内のみならず国外にも影響力を持ちうることを分析する論稿を執筆した。また、引き続き、トランプ政権の移民政策に関する判例動向を分析し、コロナ対策については比較法的考察を行う交えながら検討を加えた論文を書いた。発表については、コロナの影響もあり、オンライン報告となったが、尊厳に絡むテーマとしてヘイトスピーチを取り上げて報告を行い、外国の報告者と質疑討論などを行い、日本が外国の尊厳概念の影響を受けつつ、独自の発達をしていることを明らかにすることができた。

Reason

2020年は、コロナウイルス感染症の蔓延の影響で、海外の研究者との交流や成果報告を中心に遅れが生じていた。その遅れを完全に挽回できたわけではないが、2021年度は、信託や公益法人、憲法関係について文献調査を進め、同時にこれまでの研究成果を論文や書籍での公表を進めることができた。さらに、オンラインでの国際会議・ワークショップも広がってきたため、オンラインでの成果報告の機会が増え、ほぼ想定していたペースでの進捗を確保できたと考えている。

Strategy for Future Research Activity

引き続き、国境を超えた法の相互作用や、それによる国際的な法規範や法秩序の形成・変容の過程を動態的に分析することをめざし、1.国際的な資産の管理と承継、2.法人のガバナンス、3.非営利セクター、4.多様化する家族と個人の尊厳、5.選挙資金規正（選挙権・選挙制度を含む）、6.国境を超えた裁判、といった法領域を設定し、そこで比較法研究者である研究代表者と実定法研究者である研究分担者で協働しつつ、法分野横断的な比較法・法の動態分析を行ってゆく。こうした分析を通じて、日本法を＜国境を超えた法のダイナミックな変容の中にどう位置付けるか＞、そして＜日本法の立場から国家を超えた法秩序の形成にいかに貢献できるか＞を問うてゆくとともに、そうした問題意識を積極的に国際的に発信してゆく。2021年夏から2022年夏にかけて立教大学客員教授として来日するSeton Hall Law SchoolのJonathan Hafetz教授と、パンデミックと緊急事態法制のテーマで、日米法を比較するシンポジウムを準備する。また、パンデミック下では選挙方法も問題になったので、５の選挙資金規正の対象を少し広げて、選挙方法についての比較法分析も行う予定である。
