Outline of Research at the Start

ミャンマー憲法裁判所は、2011年の設置以来、年間数件の事件しか扱っておらず、人権保障という観点から、西欧立憲主義が意図する目的を果たせておらず、機能不全に陥っている。東欧・旧ソ連の社会主義国も、体制転換にともない、権力分立、人権保障といった西欧的な立憲主義理念のもと、多くの国が憲法裁判所設置した。本研究は、社会主義からの体制転換に着目し、ウズベキスタンを比較の対象とし、ミャンマーがなぜ憲法裁判所制度を導入し、社会主義・軍政時代の権力統合原理が違憲審査制度にどのような影響を与え、人権保障メカニズムの問題点を明らかにする。

Outline of Annual Research Achievements

ミャンマーでは、2021年2月1日にクーデターが発生し、緊急事態宣言により、三権を国軍最高司令官が掌握している。緊急事態宣言の発令は、憲法上2年までとされているが、憲法裁判所により、現状は「通常」の状態ではなく、2年を超えての延長は合憲であるとの判断が出されている。最初の緊急事態宣言が出されてから3年が経過した2024年1月にも再び延長宣言がなされ、宣言解除の見通しが立たず、権力分立に課題を抱えた状況が続いている。
2023年度は、代表者が所属する名古屋大学法政国際教育協力研究センター(CALE)が2024年1月に開催したアニュアルカンファレンスにて、研究報告を行った。その際、ミャンマー憲法裁判所裁判官の任命制度と判決を分析した。裁判官の任期が連邦議会、大統領と同じであり、政権が交代するたびに新しい憲法裁判所が発足するというのが特徴である。元軍人が大統領であった第1期、第2期は、国軍の影響が強い構成であった。特に第1期は、退役軍人が含まれるなど、国軍の影響が非常に強かったが、積極的に違憲判決を出すなど、比較的機能していた。大統領と議会の対立による裁判官全員の弾劾事件を受けて、第1期では大統領寄りだった人事が、第2期では議会寄りの人事となり、議会に反する判断をしなくなった。第3期の民主化勢力の国民民主連盟(NLD)政権となってからは、国軍の影響が少ない弁護士の登用が目立ったが、前政権からの留任もあり、必ずしも偏った人事ではなかった。ただ、議会に反する判断を出さないという点に変わりはない。第4期である現在は、全権を国軍最高司令官が掌握しており、すべての任命権は軍事政権の最高意思決定機関である国家行政評議会が担っており、軍事政権にお墨付きを与える役割を担っている。

3: Progress in research has been slightly delayed.

Reason

ミャンマーについては、引き続きクーデターによる緊急事態宣言が継続し、現地調査が実施できず、政府のウェブサイトもアクセスできないことも多く、情報収集に課題が多い。2022年度に研究協力を得られることとなったミャンマー留学生(公務員)は、ミャンマー政府の命令で帰国を余儀なくされた。当該元留学生やこれまで関係を構築した憲法裁判所、またヤンゴン大学内に設置した名古屋大学ミャンマー・日本法律研究センターなどの協力を得て、憲法裁判所裁判官の経歴や判決などの情報収集を行った。しかし、緊急事態宣言が発令された軍事政権下で、遠隔での情報収集は限定的にしか行うことができず、自由な発言が制約される中での議論となり、思うように研究が進まなかった。
一方、ウズベキスタンについては、現地調査を実施し、憲法裁判所、人権研究センターに加え、国際連合人権高等弁務官事務所(UNHCHR)、欧州安全保障協力機構(OCSE)などの国際機関に訪問し、インタビュー行ったり、カンファレンスに参加したりした。2023年のウズベキスタン憲法改正により、伝統主義への回帰が多く見られたが、憲法裁判所は、伝統主義の概念を解釈に対する意識が薄く、人権保障との間で対立が生じる可能性がある。ただ、海外の援助機関は、ウズベキスタンの憲法裁判所について、人権オンブズマン、人権研究センターなどいくつかの公的機関、さらに一般市民も直接提訴できるようになり、権利保障メカニズムの確保に向けて一方前進したことを評価している。
2023年度は、ベトナムでも調査を行い、ベトナムにおける人権制約原理の理論や党権力のあり方についてインタビューを行った。

Strategy for Future Research Activity

ミャンマー憲法裁判所は、民政移管により「法の支配を保障するしくみ」として憲法裁判所を設置したと説明しているが、それに懐疑的な見地から、本研究を始めた。ミャンマー憲法裁判所は、個人の憲法裁判所への提訴権はなく、本研究を通じて、個人の人権保障のための機関ではなく、政権の正当化やイエスマンとしての役割を担わせるために構想したのではないかと考えるようになった。それは、憲法裁判所が議会と大統領と同じであり、議会と大統領により指名されるという、時の政権と密接に関わる任命の仕組みとなっていることが理由である。2023年度の研究を通じて、2008年憲法を起草した国軍は、政権を奪われることはないと想定していたことも明らかになってきた。
アニュアルカンファレンスでは、コメンテーターから、ミャンマーの憲法裁判所の役割が、本当に正当化やイエスマンなのかという疑問が呈された。権威主義体制の国家では、憲法は権利を保障したり制限したりするためにつくられるのではなく、統治機構内の利害対立を調整するための作業手順書として機能していることが多い。ミャンマー憲法裁判所も、国軍内の利害対立を調整し、組織が破綻しないようにするための役割を担っているのではないかという指摘を受けた。
また、権威主義国家が民主化する過程で、多くの新興国が憲法裁判所を導入した。このトレンドに乗らなかった国とミャンマーは何が違うのかというと、民主化勢力という国軍に対する抵抗勢力がミャンマーに存在したということだが、反対勢力との調整のための機関として設立されたのではないかというコメントも受けた。
これらのコメントを受けて、改めて他の権威主義国家との比較を通じて、ミャンマー憲法裁判所に期待されている役割を検証していきたい。
