| Outline of Research at the Start |
サイバー犯罪は年々深刻さを増しているが、我が国ではそれに係る刑事訴訟法学及び刑事政策学の研究者は非常に限られており、サイバー犯罪をコントロールするための法的規則の在り方に関する研究は、サイバー空間発展の速度に見合う進展をしていない。
本研究は、サイバー犯罪が多発し、効果的な法制度が整備されつつある米国とEU諸国で調査を行い、実用性の高いサイバー犯罪対策について国内及び国際社会に向けた提言を行うことで、サイバー犯罪に現実に対処する実務の改善につなげる。

| Outline of Annual Research Achievements |
前年度から引き続き、国境を越える証拠収集を飛躍的に容易にすることが期待される米国クラウド法の枠組の研究を行った。特に、同法の枠組を利用するために必要な米国との行政協定を締結している英国と豪州との協定の内容、協定締結時における米国の検討事項について研究を行った。具体的には、次の各文書等を翻訳するなどした。その成果を2023年11月に開催された「コンピュータセキュリティ法制学会」勉強会において発表するとともに、近く早稲田大学法科大学院ローレビュー「Law & Practice」において公表予定である。

2: Research has progressed on the whole more than it was originally planned.
Reason
研究開始後、新型コロナウイルス感染拡大により、当初予定していた海外調査研究等が実現できなくなったところではあるが、インターネット上に公開されている海外の政府情報や学術文献の研究を継続することにより、当初予定していた研究を概ね遂行することができており、2024年度は最終段階として研究のまとめの段階に入ることとしたい。

2024年度は、さらに海外文献調査を進めるとともに、可能であれば海外調査研究を実施して米国クラウド法の運用実態にせまりたい。また、実務的な研究であるので、研究の成果を政府機関や学会に還元すべく、講演会等により周知を図ることとしたい。
