Outline of Research at the Start

金融資本市場のゲートキーパー（門番）である格付機関や金融アナリスト等は、企業の財務分析等の妥当性を審査する任務を担い、その審査結果は投資家の投資判断にも多大な影響を与える。そうであれば、その機能を果たせなかった場合において各ゲートキーパーに係る民事責任に関して、どのような規律が必要なのかが問題となる。こうした観点から、その全体に及ぶ横断的研究を進めることが重要であるとの認識に基づき、わが国の立法作業への提言を含め、各ゲートキーパーに固有の法的規制と民事責任のあり方を基礎に、金融資本市場における専門家責任論の構築を目指すことが、本研究の概要である。
