| Outline of Research at the Start |
本研究は、公私協働組織のガバナンスについて、公法学の観点から検討を行うものである。
これまで、わが国の学説・法制度においては、公私協働のあり方について組織法的な観点からガバナンスの議論は、必ずしも十分には展開されてこなかった。
このような問題意識に立脚して、本研究は、公私協働組織（第三セクター、外郭団体等）のガバナンスに関連する日独の法理論・法制度の比較研究を行うとともに、両国の公私協働組織の実態を把握するための現地調査（ヒアリング）を実施し、実証的な視点も取り入れながら、公私協働組織のガバナンスに係る法理論の構築と法制度設計について検討を行うとともに、一定の提言を行うことを目的とする。

| Outline of Final Research Achievements |
In public law of Japan, the problem of Organisations-PPP (public-private partnership) was not concretely researched. Considering this situation, the research project examines legal theory, legal systems, and legal policies related to the Governance of Organisations-PPP in Japan and Germany.
As a result of the research project, “Local Public Service and Public Private Partnership: A Research from a perspective of public and organization law " (MIYAMORI Seiji, NIPPON HYORON SHA, 2023) was published.

| Academic Significance and Societal Importance of the Research Achievements |
本研究課題は、「自治体」、「事業」、「組織（法）」という独自の視座設定に基づくことで、これまで行政法学において議論されてきた公私協働論とは異なる観点からの検討・分析を行っている点、行政法学の体系のみならず、隣接する法律学（憲法、会社法）や隣接学問領域における議論を踏まえ、様々な研究手法を組み合わせることで、横断的・学際的・多層的な分析を行っている点において、学術的意義が認められる。
近年、人口減少・少子高齢化を背景として公私協働による政策遂行には大きな注目が集まっているところ、本研究課題は、具体の形成事例を踏まえた検討を行っており、実務の参考ともなり得る点において、社会的意義が認められる。
