| Outline of Research at the Start |
近年、家族形態の多様化が進み、従来の家族モデルに当てはまらない家族が増えている。しかし、子連れ再婚家族やLGBT家族のような非伝統的な家族において、子と育ての親との間で長期間にわたり実親子と同様の生活実体を形成してきたのにもかかわらず、法律上の実親子関係は認められないことが多い。一方で、育ての親に愛着を抱いている子の最善の利益を考慮すれば、法律上の複数の実親が認められる余地があり、諸外国では実際に立法や判例の動きがみられる。本研究では、従来の実親子関係を比較法的な観点から再検討し、法律上の複数的な実親子関係について解釈論・立法論的な動向を分析し、日本法における議論への示唆を得ることを目指す。

| Outline of Final Research Achievements |
Given the increasing number of nontraditional families, such as stepfamilies, families formed by same-sex and/or transgender parents, and families formed through assisted reproductive technology, this study examines, from a comparative legal perspective, various jurisdictions worldwide that have made the current two-parent framework more flexible by acknowledging dual legal maternity, dual legal paternity, and multiple legal parentage. Ultimately, the study discusses the implications of multiple legal parentage on Japanese law.

| Academic Significance and Societal Importance of the Research Achievements |
家族形態の多様化が進む中、同性愛者家族や子連れ再婚家族、生殖補助医療を利用した家族など、従来の伝統的な家族形態に該当しないとされる家族が増えている。これらの家族を支える法整備は国際的な課題となっているにもかかわらず、日本における関連研究の蓄積が未だ十分とはいえない。本研究は、子の最善の利益という観点から、複数の実親子関係の可能性について検討・分析を行った点において、学術的および社会的に意義のあるものである。
