| Outline of Research at the Start |
動産文化財は、取引によって越境移動することがある。そのような国際的な文化財の移動についての規制には、国際法・国際私法・国内実質法上の法整備や税関の実務におけるキャパシティビルディング等、様々な法的課題がある。本研究は、文化財の国際的移動に関する法整備やガバナンスの方向性に、国内的・国際的提言を行うことを目標にしている。また、そのような提言を行うにあたっては、文化財の国際的移動に関するデータの分析に有効な方法論を提案することも計画している。

| Outline of Final Research Achievements |
This research clarified the usefulness of data analysis using Bayes' theorem in considering the design and operation of systems for international cultural property trading (Ren Yatsunami, A Methodological Consideration on International Trafficking of Cultural Property: An Approach from Bayesian Statistics, Gdansk Legal Studies, 28-46, 2021, no.2 (Cultural Heritage Law), 2021). In addition, this research a mathematical model for studying synergies between different legal systems.

| Academic Significance and Societal Importance of the Research Achievements |
本研究は、国際的な文化財取引規制を検討するために、ベイズの定理を用いたデータ分析を用いた。インターポールが公表している文化財犯罪の統計に関する文書（Assessing Crimes Against Cultural Property）等、関連分野でデータ蓄積の取り組みは続けられている。その情報は、1970年条約加盟国を中心に重要な情報として参照され、各国の税関職員の研修やその実務において活用が図られている。しかし、それらの情報を用いたデータ分析によって、制度の設計や運用のあり方を見直すような研究はこれまで十分に展開されてこなかった。そのため本研究によってその方法を展開したことには意義がある。
