Outline of Research at the Start

タイ憲法は，自然資源に係るコミュニティの管理・利用権と参加権を保障している。従来そのための具体的な法律は未整備であったが，2019年に水資源法とコミュニティ・フォレスト法が相次いで制定され，新法の具体的な執行方法が喫緊の課題となっている。
本研究では，新法の執行強化と改善のために，北タイの自然資源管理研究に実績のあるMae Fah Luang Universityと共同研究グループを組織し，①コミュニティの権利の内容と性質，②新法の到達点と課題，③コミュニティ参加型の管理組織と手続のあり方を検討し，自然資源をめぐる紛争の解決に向けた枠組みを提示する。

Outline of Annual Research Achievements

タイ憲法は，自然資源に係るコミュニティの管理・利用権と参加権を保障しているが，これまで参加を具体化する法律は未整備であった。これらの問題を改善するために，2019年に水資源法とコミュニティ・フォレスト法が相次いで制定され，現在，新法の具体的な執行方法が議論されている。本研究は，①コミュニティの権利の内容と性質，②新法の到達点と課題，③コミュニティ参加型の管理組織と手続のあり方を検討し，新法の執行強化と改善に向けた具体策を提示することを目的とする。
今年度は，Mae Fah Luang大学のメンバーも交えた打ち合わせ・研究会を4回開催するとともに，バンコクにおいて，研究者，政府機関，NGO等を訪問し，森林管理および水管理に関する共同調査を行った。これにより，森林管理については，コミュニティ・フォレスト法に関し制定されたばかりの多くの下位法令を入手できたほか，同法の意義，評価について多様な主体と意見交換を行うことができた。これらの下位法令は日本では入手が困難であったものであり，法制度の詳細が以前よりも明らかになった。
また，水管理についても，水資源法のもとでの複雑な権利・権限関係について，新たな知見を得ることができた。いくつかの関連法令・計画も入手できたが，コミュニティ・フォレスト法に比して英語資料が限られており，分析にはより時間を要することが課題である。
さらに，タイだけではなく，ASEAN各国でコミュニティ参加型の資源管理が重視されるようになった社会的背景や現在の課題について，国際機関の研究者等と踏み込んだ議論を行うことができた。

Reason

2022年度は，現地での調査により，日本では入手が困難であった多くの下位法令を入手することができたこと，政府機関のみならず，研究者，NGO等と具体例を挙げつつ議論したことにより，現状分析が大きく進んだ。また，本研究終了時の研究成果の出版についても企画が具体化し，出版社との協議がおおむね整った。

Strategy for Future Research Activity

2022年度に引き続き，第１に，タイの水・森林管理関係法令の整理・分析を行う。昨年の現地調査により，多くの下位法令を入手できたものの，それ以外にも現在策定中の下位法令のあることが判明しており，最新動向の把握にも努める。
第２に，2022度は国レベルの動向に焦点を当てた分析を行ったが，地域レベルでの法律の執行状況，独自ルールの作成，現在の課題等については十分な分析ができていない。そこで，2023年度は，北タイにおいて，Mae Fah Luang大学とともに水・森林資源管理に関するヒアリング調査を行う。
第３に，これらタイ国内の制度の研究に加え，メコン流域諸国やメコン委員会を含む関係国際機関における参加原則の動向についても文献調査を行い，地域的特徴や課題の明確化作業を継続する。
