Outline of Research at the Start

本研究は、国際裁判における宣言判決をめぐる国家の裁量とその統制のあり方を国内・国際の両面から分析するものである。具体的には、国際社会の公共的利益（国際公益）の保護に関わる義務（いわゆる対世的義務）の違反に関連する国際裁判（「国際公益訴訟」と呼ぶ）に着目し、豪州および日本の国際裁判・外交実践を取り上げて比較分析することにより、紛争の包括的解決に向けた国家および国際機関による多機関協働を宣言判決が導き出す法的・政治的条件を明らかにする。
