Research Abstract |
1.Criminal insanity or diminished responsibility is a pre-requisite for the medical treatment by the Medical Care and Supervision Act. In the legal context, the confrontation of gnosticism and agnosticism dose not directly link to the judgment of insanity defense. 2.Whether a mentally disorderd criminal is subject to the medical treatment by the Medical Care and Supervision Act is applied by the three conditions : 1.types of criminal offence, 2.insanity or diminished responsibility at the time of the offence, and 3.need for medical treatment(illness, treatment response, disincentiveness to rehabilitation). Personality disorders, developmental disabilities and drug addicts tend to be excluded from the medical treatment by the Law because they lack treatment response. But their access to medical treatment or care should be guaranteed and further discussion is to be had.
