Research Abstract |
The purpose of this study was to analyze the interface between the international legal theories and the environmental treaty negotiations, in order to highlight how general international law theories put the framework on and establish the foundations for the emerging treaty systems. In certain cases, for example in the field of environmental liability regimes, the general theory advocated by "professor-diplomats" was reflected in the treaty system. However, in other cases, the political considerations on the negotiating ground overwhelmed the plea for consistency with general theories of treaty interpretation and created special regimes, furthering the fragmentation of international law.
