Research Abstract |
After World War II, Radbruch argued that legal positivism asserting ‘law is law’ had left German lawyers and the people ‘unguarded’ from the terrible injustices of Nazism. This indication (‘Radbruch’s Thesis’) has recently been subjected to a negative evaluation, based on historical studies of legal practices in the Nazi era. But this evaluation is shown to be inappropriate, in contrast with Radbruch’s real intention, as elucidated from his earlier works.
